These Terms and Conditions ("Terms") govern the use of the website and all services offered by MojoXpress ("Company", "we", "our", or "us"), a company engaged in export facilitation, logistics management, and international freight forwarding, with registered offices in Nairobi, Kenya and London, United Kingdom. By accessing our website, submitting an enquiry, entering into a service agreement, or engaging our services in any capacity, you ("Client", "Customer", or "you") confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use our website or engage our services. These Terms shall apply to all contracts for services entered into between the Company and the Client unless otherwise agreed in writing.
Quotation, orders, and contracts
- Quotations: All quotations issued by the Company are valid for seven (7) calendar days from the date of issue, unless otherwise specified in writing. Quotations are subject to change based on fluctuations in carrier rates, fuel surcharges, exchange rates, port charges, or any other relevant factors beyond the Company's control.
- Documentation: Accurate and complete shipping documentation must be provided by the customer.Any variation to an accepted order must be agreed in writing by both parties. The Company reserves the right to charge for any additional costs arising from variations requested by the Client.
- Prohibited Items: Transportation of hazardous, illegal, or restricted goods is strictly prohibited.
Liability and Insurance
- Limited Liability: MojoXpress is not liable for loss or damage caused by events beyond our control, such as natural disasters, strikes, or acts of terrorism.
- Insurance: Customers are responsible for securing insurance coverage for their goods unless explicitly agreed upon.
- Claims: All claims for loss or damage must be submitted in writing within specific timeframe, e.g., 14 days of delivery.
Payments Terms
- Invoicing: The Company will issue invoices in accordance with agreed billing cycles or upon completion of service milestones. All invoices are payable within fourteen (14) calendar days of the invoice date unless otherwise agreed in writing.
- Currency: Invoices shall be issued in the currency agreed in the Service Agreement, which may be Kenyan Shillings (KES), Pounds Sterling (GBP), US Dollars (USD), or such other currency as mutually agreed. The Client bears all foreign exchange conversion costs unless otherwise specified.
- Late Payment: The Company reserves the right to charge interest on overdue amounts at a rate of 2% per month (or the maximum permitted by applicable law, whichever is lower), compounded monthly from the due date until the date of actual payment. The Company also reserves the right to suspend services in the event of non-payment.
- Disbursement: The Client shall reimburse the Company for all reasonable out-of-pocket expenses, duties, taxes, port fees, customs levies, and other third-party charges incurred on the Client's behalf. The Company shall provide supporting documentation upon request.
Cancellation and Changes
- Cancellations: Cancellations must be made in writing and may be subject to cancellation fees.
- Changes to Booking: Any modifications to a booking must be approved in writing and may incur additional charges.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of Kenya. In respect of services provided from or to the United Kingdom, the parties acknowledge that UK statutory rights and consumer protection laws may apply, and nothing in these Terms shall operate to exclude or limit any rights that cannot be excluded under applicable UK law. The courts of Kenya shall have primary jurisdiction over any dispute not resolved by arbitration, without prejudice to the Company's right to seek injunctive relief or enforce an arbitral award in any competent jurisdiction, including the courts of England and Wales..Contact Info
